Financing is one of the main challenges in the turnaround of struggling companies. Faced with cash flow constraints, excessive debt, or a loss of confidence from their financial partners, these companies must mobilize appropriate resources to ensure their survival and facilitate their restructuring.Within the OHADA region, several financing mechanisms can be considered, whether internal (self-financing, capital increases, advances from shareholders' current accounts) or external (bank and non-bank financing). However, the financial fragility of a company in crisis significantly limits its access to these traditional sources of financing.Through a comparative analysis of insolvency law (AUPCAP) and OHADA corporate law (AUSC-GIE), this book identifies the financing techniques best suited to support corporate recovery and to be incorporated into a composition-with-creditors proposal. It highlights solutions capable of reconciling the sustainable restructuring of the company with the protection of the interests of creditors, investors, and shareholders.
