Following the ECHR's successive rulings against France, the question arises as to whether this will force France to legalize surrogacy-something it has so far refused to do, despite developments in this area in neighboring countries. Indeed, in recent years, the use of surrogacy abroad has become increasingly common, raising legal issues regarding the child's parent-child relationship as well as its recognition under French law. This book seeks to address these issues by analyzing the case law of the ECHR as well as French law, in order to put into perspective the significance of these rulings concerning France's refusal to recognize civil status records of children born through surrogacy abroad under French law. The book will also briefly examine legal systems in other European countries to contextualize France's position within the broader European framework governing legislation on surrogacy.
