Fundamental Rights of Persons Deprived Liberty in Bolivia

The recognition and protection of fundamental rights constitutes one of the essential pillars of the Constitutional State of Law, in the Plurinational State of Bolivia, the validity of constitutional rights and guarantees is not suspended by the condition of deprivation of liberty of a person, but, on the contrary, imposes on the State greater obligations of respect, protection and guarantee.Persons deprived of liberty are in a situation of special vulnerability, due to the fact that their custody depends directly on the state administration, which is why the national and international legal system has developed a set of principles, rules and mechanisms designed to prevent abuse, cruel, inhuman or degrading treatment, as well as to ensure respect for human dignity.
