'¿In dubio pro sanitate?¿ Legitimization and Application of Coercive Medical Measures under German Guardianship Law': Mental illness challenges legal principles, particularly when medical treatment must be administered against a person's will, creating conflict between self-determination and coercion. Drawing on psychiatric research, this thesis analyzes Sections 1831 and 1832 of the German Civil Code (BGB) and the influence of advance directives. It emphasizes the ultima ratio principle and the importance of procedural safeguards, but also demonstrates that certain requirements are applied too restrictively.
