International Contract Law 2003

The present collection of articles is the 14th in the Molengrafica Series under the aegis of the Molengraaff Institute for Private Law, a series which has been issued since 1988. In the Series some of the results emanating from research carried out in the fields of international commercial contracts and intellectual property law are published. This research was carried out during the last decade by researchers belonging both to the faculty of the Institute and working incidentally or regularly in cooperation with the Institute. In each issue of the Series the approach is comparative with special attention being paid to legal developments in Europe. This volume contains a collection of essays on various aspects of European and related international contract law, presented over the last ten years on different occasions and for various forums, which the editors for at least two reasons consider worth republishing in an aggregated form. First, republishing gives a proper and representative account in the English language of the research carried out within the Institute's research programme in European private law, which so far has not been available. Second, although some articles date back a number of years and others have been published more recently, their themes (e.g. formation, content, and harmonisation) are equally and invariably topical, whereas the way in which these themes are addressed is illuminating for the ongoing development of the law in this domain.
