Private enforcement in competition law

Private enforcement encompasses all civil actions under competition law. It is therefore a mechanism for enforcing antitrust law. This book aims to guide the reader through the complexities of the subject, which, under European positive law, proves to be a highly contentious issue. To facilitate a full understanding of the subject, it will be examined in a way that provides insight into US law, which served as the inspiration for European law on private enforcement. Frequent reference will be made to the criticisms that can be levelled at the current system, as well as to hypothetical or existing solutions that might remedy it. This approach to the subject aims to offer a different perspective on private enforcement by applying a critical eye and an open-minded outlook. This book is up to date with the European Directive of 17 April 2014, as well as the proposed reform of the law of obligations.
