the death penalty in context of medieval Inquisition: concept evidence and its relationship with secular arm

A broad topic such as the death penalty must be examined within a historical context that allows for a genuine understanding of it. Mere criticism from a biased observer is not enough. It must be understood and studied, focusing on the elements relevant to its development. Based on these premises, the classical civilisations that addressed the subject and influenced its evolution in the field of law were examined. Thus, in Antiquity, the focus was on the precepts developed by the Sumerians, as well as Hebrew and Roman law. The latter, due to the influence it exerted on the peoples of the West, was the necessary means of arriving at Canon Law, the basis of the entire Medieval Inquisition. Its procedures, in particular the dogmatics employed by the Church during the period known as the Middle Ages, were analysed within a broad perspective, seeking out the positive and negative aspects of the inquisitorial system, whilst not neglecting to focus on the death penalty. Finally, as it was the means employed in the implementation of the repressive technique developed, torture was discussed, given its close link to the death penalty.
