The unaccountability of minors: Increased insecurity

Ecuador faces a serious insecurity crisis, characterized by the violent actions of criminal groups. In 2024, President Daniel Noboa declared an "internal armed conflict", recognizing these organizations as terrorists. In this context, thousands of minors have been arrested for serious crimes, evidencing their active participation in criminality.The inimputability of minors has favored the increase of these crimes, since they are not tried under the ordinary criminal regime. The Código Orgánico Integral Penal establishes that they must be subject to socio-educational measures, prioritizing their reintegration. This approach is based on their lack of maturity and on international standards such as the Convention on the Rights of the Child, which obliges the protection of their rights and establishes a minimum age of criminal responsibility.
