'Alternative Conviction and Theories of Criminal Punishment': The thesis assesses whether, and to what extent, the defendant may be convicted, in the case of an alternative determination of facts under the law, for one of several different offenses. Contrary to the prevailing opinion, the defendant is not to be convicted alternatively only if the alternative offenses are comparable from a ethical and psychological standpoint. From the perspective of theories of criminal punishment, an alternative conviction is warranted in every case.
